It’s been a busy year for the Federal Communications Commission: leadership changes, shutdowns and sequesters, and increased pressure from Congress and its core industry-constituents to "modernize" itself.

Today, Radio’s Digital Dilemma: Broadcasting in the Twenty-First Century was formally unleashed upon the world.
As I’ve said before, for the most part it’s a work that chronicles an important constitutive moment in the history of U.S. radio broadcasting, and holds lessons about how our system of contemporary media policymaking works (or doesn’t) more broadly. Congress Tries Intimidating FCC to Drop Information Needs Study
Last month, the Federal Communications Commission announced it was preparing to conduct a test of its protocol for a "multi-market study on critical information needs" in Columbia, South Carolina. The study proposal suggests a two-pronged approach: the first is a "media market census" which will look at broadcast, newspaper, and online news content in sample markets around the country. The second prong is a "community ecology study" in which surveys will be conducted to "measure community members’ actual and perceived critical information needs." This will be coupled with "in-depth neighborhood interviews" involving actual citizens.
With studies like these, the devil is in the details. There’s no clear definition of what "critical information needs" actually are, and while the proposal plans to focus on these needs from the perspective of "vulnerable/disadvantaged populations," these are also not clearly defined. Sample-size is also key: this particular study will look at six media markets—two large, two medium, and two small—and we still don’t know what other five markets will be involved. RadioDiscussions Killed By Greed
It certainly hasn’t been a kind year for online radio discussion sites.
For more than a decade, one of the most vibrant sites online to talk about U.S. broadcasting of all stripes was RadioDiscussions.com. It began in the late 1990s when three radio enthusiasts merged their own bulletin boards into a common site called Radio-Info, providing an outlet for discussion about dozens of speficic radio markets, boards for every state, as well as specialty forums for things like community radio, digital radio, engineering, and FCC policy. HD Radio Gets Trolled
HD Radio finds itself under attack in the courts from an unlikely agitator: the patent troll.
What is a patent troll? In a nutshell, they are scumbag bottom-feeders in the land of intellectual property law. Patent troll companies have no real business; they buy up existing patents and then launch campaigns of lawsuits against others that are using "their" technology, claiming that the defendants have violated "their" intellectual property rights.
The idea is to intimidate defendants into making quick settlements, avoiding a potentially costly lawsuit. Even though their claims often have no legal merit—or the patent itself is so vague as to be difficult to define—companies targeted by patent trolls will often settle just to get the nuisance out of their hair. While this might be tactically acceptable, it sets a terrible strategic legal precedent, as it gives a patent troll more courage to continue and expand their campaigns.
Legal scholars have estimated that patent trolls raked in some $29 billion from their nefarious activities in 2011. That same year, WBEZ’s This American Life produced an excellent episode that breaks down patent trolls and their modus operandi. The top five patent trolls in the country have collectively sued several thousand companies large and small over the last five years.
In the case of HD Radio, earlier this month a Delaware-based patent troll named Wyncomm, LLC, representing its "subsidiary," Delaware Radio Technologies (for all intents and purposes, both are shells established for the purposes of patent-trolling), sued several broadcasters using HD Radio. The primary patent at issue was initially awarded to AT&T in 1996 and covers "side channel communications in simultaneous voice and data transmission." Radio's Digital Dilemma On the Road
Been a busy month so far: I started out in San Francisco at the Union for Democratic Communications annual conference, where I got to give a preview of my new book and its gory details. It was well-received, especially among policy scholars who hunger for some good old-fashioned muckraking.
Then I was in Australia last week for the Community Broadcasting Association of Australia’s annual conference. I was the Saturday keynote, and compared to Australia’s digital transition, the U.S. looks positively retarded. The talk itself was recorded, but no word on when it will be online. AM Revitalization Initiative Unleashed: All Digital Transition On the Table
And sooner than expected: the FCC will soon open a comment window for a plethora of proposals to assist beleaguered broadcasters. Paul Riismandel at Radio Survivor has a decent breakdown of the agency’s primary suggestions, and also notes that there’s "nothing on the all-digital question." If only this were true.
Just because the all-digital idea is not sharply delineated in the FCC’s Notice of Proposed Rulemaking doesn’t mean the agency’s not interested in it. Policy studies necessitate close reading. For example, the agency notes its permissiveness with all-digital AM-HD experimentation as one of several "discrete changes" it’s made over the years "designed to further enhance the AM service" (p. 5). FCC Anti-Pirate Efforts Focus on NYC
It was a pretty busy summer for the federales, who not only managed to roll out their own version of the Enforcement Action Database, but made moves against pirate radio broadcasters in nine states. Among them, New York saw the vast majority of this action.
Of the 80+ recently-logged enforcement actions (which brings the yearly total to 200), nearly three-quarters of those happened in four of the five boroughs of New York City.
In the month of July alone, FCC agents visited and sent warning letters to more than two dozen pirates in the city; one unlucky station op in Queens got two visits and warning letters within this time span. Continue reading “FCC Anti-Pirate Efforts Focus on NYC”
Firming the Foundation for an All-Digital AM Mandate
The quiet collection of "evidence" on which to justify an all-digital HD Radio mandate for AM stations continues.
After some stealth experimentation on a CBS station in Charlotte, North Carolina late last year, there’s word of two other AM stations in the state conducting all-digital broadcast-tests this summer. The guinea pigs were WBT, a 50,000-watt station owned by Greater Media (also in Charlotte) and WNCT, a 50,000-watt (day)/10,000-watt (night) Beasley Broadcast-owned AM station in Greenville.
WBT secured experimental authorization from the FCC to conduct these tests just two weeks before they took place; WNCT also asked for fast-track authority less than a month before its all-digital broadcasts. Continue reading “Firming the Foundation for an All-Digital AM Mandate”
Here Comes the Hammer: Pacifica to Lease Out WBAI
Uh-oh, indeed. Pacifica’s National Board is now soliciting bids to take over the programming and operations of its station in New York City. WBAI is prime real estate, transmitting with 4,300 watts of power from atop the Empire State Building on a choice frequency smack dab in the middle of the FM dial. The station’s worth tens of millions of dollars were it ever to be sold.
This was a long time coming. WBAI, like many of Pacifica’s radio stations, is caught in the jaws of a dilemma as old as community radio itself. Essentially, people can lose sight of the actual goal of running a successful and sustainable community radio station and instead use (and abuse) the station as a battlefield on which to act out some larger sociopolitical struggle. What the station stands for becomes more important than the station itself, and nobody wins. In Pacifica’s case, they stand to lose it all.
